taken on October 11 & 18, 2010; November 12, 2010, and March 18 & 28,
2011, by all members of Fontana Unified School District with the
exception of Police Services which will be determined by the
Superintendent.

FUSD School Board approves reduction of school
year to 175 days
The
FUSD School Board approved the reduction of the 2010-2011 school year
from 180 days to 175 days. This approval allows for the
implementation of budget cut days by FUSD. FTA members approved 5
mandatory budget cut days for 2010-2011 and entered into an MOU with the
district regarding those days.
FTA and Steelworkers representatives met with
district administration to determine on which dates the district will be
closed. Mandatory
budget cut days are to be taken on October 11 & 18, 2010; November
12, 2010, and March 18 & 28, 2011 with the exception of Police Services,
which will be determined by the Superintendent. Utilization of five
furlough days would result in the following budget reductions:
Fontana Teachers Association $4,125,305.00 United Steelworkers
$1,036,920.00 All others $542,470.00 Utilities $121,000.00
Total $5,825,695.00

Members vote to accept 5 Budget Cut Days
FTA members have been voting this week to accept or reject an MOU
on 5 budget cut days for the 2010-2011 school year. Today at
3pm, members of the negotiations team gathered to verify signatures and
count the ballots. Here are the results of the vote.

FTA will meet with FUSD and
other bargaining units to determine when the budget cut days will occur.

Open Letter to Members Regarding Budget Cut Days MOU
One of theoneOne has to ask, “Why approve this MOU if it does not guarantee that
teachers will be rescinded when our members take Budget Cut Days.”
That is a good question. Remember
that this MOU is an understanding between both, the FTA and FUSD. There
are protections against any further cuts for 2010-2011, and while there
are no guarantees about returning member’s jobs, there are conditions
that allow FTA to monitor fiscal conditions, and put pressure on the
district to rescind members as money allows. There is also a position
statement included that says we believe getting our members back to work
is an important priority for FTA. These are important statements of
understanding. When the FUSD
and FTA signed this agreement, they agreed to that priority.
It is also a matter of transparency and honesty that you know the
facts as they exist. FTA
does not think that anyone can guarantee rescinding our teachers given
the financial deficit in our district and the state budget unknowns, but
MOU restoration language does give us a better position. If you look at
the larger picture in the surrounding districts, they are giving as
much, and in many cases more just to survive this year. I agree that the
conditions seem nebulous, but we understand the "financial triggers" and
this MOU puts the responsibility on the district to react appropriately
given that those conditions improve. Indeed the district has already
started rescinding teacher based on this MOU, pending member approval.
Remember that other measures to cut salary across the salary
schedule and freezing step and column are not part of this agreement and
remain intact. Also benefits for 2010-2011 have been maintained at the
current cost and there are still no out of pocket increases to members
on Kaiser and Blue Shield. Not every district can say they maintained
those items for their members. This is a stabilizing agreement, with the
potential to bring many teachers back to their positions. We are
cautious, and must maintain however, that the reality in this financial
crisis is that there are no guarantees to that effect.
Even though we believe this MOU helps to do just that, return
teachers to their jobs, we cannot guarantee it.
What happens if we do not approve the five budget cut days?
If we reject, then the MOU is not ratified and does not continue.
We would then have to return to negotiations or consider it dead.
The understanding regarding financial triggers will not be agreed
upon. The responsibility the school board has to identify those programs
as priorities will not be part of this agreement.
These protections against further cuts for next year will be
gone.
This year, FUSD calculated that 5 furlough days across the board,
by every employee, would be needed to balance the budget with a $30
million deficit. To our
members that is approximately a 2.7% cut in salary.
While we did not get a guarantee to return RIF’d teachers, there
is a guarantee to prevent further cuts and that is important because it
prevents August layoffs. Remember
that this MOU is only valid only for the 2010-2011 school year.
Last year FUSD would not offer a guarantee and we did not bargain
furlough days. We still have
approximately 100 members out of work.
This year the FUSD laid off another 171 members bringing the
total to 271 laid off FTA members.
Some of those members have been rescinded because we have
tentatively agreed to this MOU on budget cut days.
Because the impact of this MOU is personal and important to our
members, FTA is conducting a full membership vote.

MOU Regarding Budget Cut Days
FTA and FUSD have entered into a Tentative
Agreement on Budget Cut Days. FTA will be asking the entire
membership to vote on ratifying this agreement as an MOU. We
are posting the entire agreement here for our members to read prior
to voting.

sheet will be distributed with the ballot outlining the terms of the
agreement. Here is the short version:

The Memorandum of Understanding will reduce the 2010-2011 work year
by five days.

The reduction in work days will result in an approximate salary
reduction of 2.7% for certificated employees,

The salary reduction shall be spread equally across all paychecks.

FUSD agrees to link the Budget Cut Days to teacher jobs.
Þ
FUSD agrees to “triggers“ that will return teachers to work when
funding increases based on school board priorities.

FUSD agrees that there will be
no additional RIFs for
the 2010-11 school year.

The District will attempt to
schedule Budget Cut Days for Mondays distributed throughout the
year.

The revised 2010-2011 school year will be reported as a full year of
service credit in the State Teachers Retirement System for
certificated personnel.

PAY DAY SCHEDULE FOR NEW CALENDAR
RELEASED
FUSD has released the new pay day schedule for the new calendar
schedule adopted by the Board last March 3rd. The new pay days
reflect no change for the next school year but go to a ten month year in
2011/12. You will receive your normal salary but it will be
divided by 10 instead of 12 for the 2011/2012 school year. If you
want to spread you salary out over 12 months you would have to contact
payroll to get deferred pay. Please note that in the 2011/2012
school year that there are two missed pay months, one is the first month
of the school year 8/1/2011 and the other is the last month of the year
7/1/12. The next pay day after that would be 9/1/12 assuming that
traditional calendar would continue. For a complete detail of the
